How Long Do I Have To File a Sexual Abuse Claim in Chicago?

The statute of limitations for a sexual abuse civil suit in Chicago depends on the victim’s age. For most sexual assault cases involving adults, you must file your claim within two years from the date of the underlying incident. However, this does not apply if the civil suit is based on an underlying Class X felony. 

By contrast, if the victim is a minor and the sexual abuse occurred before January 1, 2014, they 20 years from their 18th birthday to file a claim. For child sexual abuse that occurred after January 1, 2014, there is no statute of limitations.
