What Type of Compensation Can I get for Brain Injuries in New Jersey?
Legal Expertise in Traumatic Brain Injury Cases
At Meirowitz & Wasserberg, our New Jersey TBI lawyers honed their skills over many years of practice. We understand the medical impact of brain injuries and how to translate it into effective and compelling legal arguments. Our team is made up of multiple attorneys and highly experienced legal staff. Together, we have the skill and resources to handle even the most complex brain injury lawsuit.
TBI cases often generate a high volume of complicated evidence. Often, this is due to the complex nature of medical evidence and testimony. From medical records to expert testimony, we are ready to marshall every piece of available evidence to build the strongest possible claim on your behalf.
Understanding New Jersey Traumatic Brain Injury Laws
The law governing your TBI case will depend on the circumstances of your accident. Our diverse legal team boasts a wide range of expertise that can be applied to your case. We have extensive experience in many areas of personal injury law, including the following:
- Slip and falls
- Medical malpractice
- Mass torts
- Wrongful death
- Product liability
- Workers’ compensation
- Government claims
In law, nuance is important, and each of these areas requires a specialized approach. With Meirowitz & Wasserberg on your side, you can be sure that the right attorney is handling your claim. Together, we will craft a solid case strategy uniquely tailored to your situation.
Statute of Limitations
In New Jersey, the statute of limitations governing most personal injury cases is set at two years from the date of injury. This simply means that injury victims must file their lawsuit seeking compensation within two years after they were injured.
Sometimes, there may be an exception lengthening the time you have to file. In other cases, the deadline may actually be shortened. In all cases, the governing deadline is strictly enforced. Therefore, do not wait to consult with an attorney. If you miss the filing deadline, your case will most likely be dismissed in court.
New Jersey’s Modified Comparative Negligence Law
Another important law is the doctrine of comparative negligence. If your case relies on a negligence theory of liability, as most personal injury cases do, the presiding court will apply this doctrine to distribute fault proportionately among all parties involved in the accident. Compensation will be allocated accordingly. Further, anyone who contributed more than 50 percent to an accident is barred from receiving compensation.
To illustrate, suppose you are involved in a car accident that leaves you with $1 million in damages. However, the jury in your case finds that your texting and driving contributed 20 percent to the cause of the accident. In this case, your compensation would be reduced to $800,000. However, if you contributed more than 50 percent, you cannot legally receive any compensation at all.
This law makes it especially important that you work with an attorney who knows how to push back against combative defendants and unscrupulous insurance adjusters arguing that you were more than 50 percent responsible. They would love to see your compensation reduced to zero. We are here to make sure that does not happen.
What Is a Traumatic Brain Injury?
TBI is a broad term that refers to any injury that impacts the way the brain works. According to the CDC, in one recent year alone, there were 190 TBI-related deaths each day nationwide.
Some TBIs are fairly mild, such as certain concussions, and require just a few days to recover. Others are devastatingly serious and may leave victims with lifelong impairments. Depending on the severity of your injury, symptoms may include:
- Fatigue
- Nausea
- Dizziness
- Loss of consciousness
- Loss of vision
- Slurred speech
- Abnormal mood swings
- Inability to focus
- Poor coordination
- Convulsions and seizures
- Full or partial paralysis
- Comas
Medical professionals use various methods to diagnose and grade TBIs. Two of the most popular methods are the Glasgow Coma Scale and the Rancho Los Amigos Scale.
